What is the renewal and declaration of trademark use?

On July 1, 2020, the new Federal Law for the Protection of Industrial Property was published through the Official Gazette of the Federation. Within this new legislation, the Mandatory Declaration of Brand Use is included, which we will address in this article with the information that you must take into account.

This new obligation established by the Law applies to trademarks that have been granted from August 10, 2018 onwards, so if your trademark was granted from January 2019, you must be very aware of this information.

The declaration must be submitted to the Institute during the following three months, counted from the third year after the trademark registration was granted.

The scope of registration protection will continue only in those products or services on which the use has been declared.

The greatest benefit of being able to make this declaration of effective and real use of your brand is the conservation and ownership of the brand, thus avoiding losing the exclusive use of it.
What happens if I do not make the declaration of real and effective use of my brand?

If the owner does not declare the use, the registration will automatically expire, without requiring a declaration by the Institute. Therefore, when the trademark is no longer valid, it will be able to be granted to various parties interested in registering it.

• What do I do if I did not declare the real and effective use of my trademark, I am outside the period granted by the IMPI? You have to make a new trademark registration request, contact us!
• Approximate response time: 6 months.
• Once the IMPI receives the request favorably, you have six months to deliver the digital title declaring the real and effective use of your brand, which we will deliver to you to protect the validity and ownership of it.
• Requirements:

1. Trademark title granted by the IMPI.
2. That your trademark has been granted after January 10, 2019.
3. That is within the third year of being granted.

The validity of a trademark granted before the IMPI is ten years, subject to RENEWAL.
What do you need to renew it?

• Have a title granted by the IMPI.
• Renew your trademark title within the six months prior to the expiration of its validity.

• Declare in turn the real and effective use of the brand.

What happens if I don’t renew my trademark?

The ownership of the trademark is lost and another person can request the registration of the same trademark.
