In Mexico, September is not only the month of our national holidays, social campaigns also formally begin to encourage the Mexican population, opportunities for the generation of wills.
For its part, the Ministry of the Interior at the federal level in conjunction with the National College of Mexican Notaries, has launched as every year the initiative "Put your documents in order and inherit peace of mind", offering facilities in the process for the drafting of wills.
Simple, for a simple reason: a person who, upon death, does not have her will, will generate too many legal and bureaucratic complications in her family in addition to increasing the chances of creating a fragmentation within the family nucleus.
The legal definition of the term tells us that "it is an act by which a person decides the destination of their assets after their death", that is, it is our personal decision about what we want to do with our assets (houses, personal items, cars, businesses, among other things) once we have passed away.
The main characteristics of a will are clearly marked by law, since it indicates that said document is:
Personal: you have to attend personally with a notary to prepare the will, nobody else can do it for us.
Revocable: its great advantage is that it can be modified as many times as the person so requires, the last update of the document being valid at the time of the death of the testator (person who has a will).
Free: for no reason, no one can force us to carry out the process of the will, since only we can decide for our personal assets.
When a person dies without leaving a will where he legally bases his decision on his assets, an intestandard probate trial will have to be initiated, which may be initiated by the descendants, ascendants and surviving spouse or, failing that, by collateral relatives within the fourth degree.
The only thing that this situation generates is friction between family members and the possibility of property loss due to poor legal advice.
