The statutory audit is a preventive administrative tool, which allows the company to identify possible legal problems (risks), by assessing its effectiveness, and detecting deficiencies that may lead to non-compliance with current regulations, notices, contracts, etc.
The statutory audit is applicable to various areas of your company, including civil, labor, contractual, commercial, real estate, and corporate, as well as possible lawsuits.
A statutory audit includes various aspects, ranging from a thorough review of each of the legal acts carried out by the company with its internal and external suppliers, and the presentation of the service it provides, such as contracts concluded between natural or legal persons, in the legal framework of its operation, in order to verify the legality of its celebration.
Regarding the above, specific actions are created in order to allow your company to carry out its daily activities with the minimum problems, which could legally and economically impact the stability of the organization.
The purpose of an audit is to verify the legality of the contracts, to identify the economic amount of its obligations, to clarify discrepancies in its accounting or finances, and to establish the value of a brand, among others. The statutory audit is oriented to legal acts, documented in agreements or contracts concluded internally and with third parties, as well as the annexes, legitimacy and personality, compliance, bonds or credits of the company, brands, even from the first act (which is the constitution of the company itself), the tax regime and its objective.
The result of the statutory audit is presented to the company through documents called: "audit report" and "statutory audit opinion".
Once the audit is completed, all documents, formats, clause corrections, and legal strategies that are recommended in order to avoid or minimize legal risks, are delivered to the audited company, specifying the consequences. This way, the company will be able to establish the necessary mechanisms to be applied, in addition to incorporating the recommendations of the legal audit opinion in each of the audited areas, prepare the necessary documentation and contracts, and in the future, establish departmental or area audits to verify whether the recommendations of the audit report have been met and implemented.
